Final Sale & Transfer of Risk: All sales are final. Plants or goods cannot be returned or withdrawn under any circumstances. Upon exiting the nursery gate, the customer assumes full responsibility for the health and condition of the plants.

Seeds & Germination: The company is not responsible for germination percentages, nor the specific ratio/percentage of male or female plants resulting from seeds.

Yield & Performance: Yield quantity and quality depend entirely on the buyer's cultivation practices, climate, soil, and water quality. Figures shown in brochures represent results under strictly controlled, favorable conditions and are not a guarantee of field performance.

Pests & Disease: The company is not liable for attacks by viruses, nematodes, fungi, or insects after sale. While certain varieties (e.g., Papaya) may have resistance to specific viruses like PRSV, the nursery does not guarantee immunity or offer compensation for infections.

Mortality & Survival: No compensation is provided for plant mortality after delivery. Survival depends on the farmer’s agricultural practices and climatic conditions during planting.

Papaya Specifics:

• Flower drop can occur due to weather extremes, improper spraying, or pests and is not a defect of the plant.

• Intercropping is strongly discouraged as it causes disease.

• Variation in fruit size may occur due to nutrient deficiencies.

• The company is not responsible for the sex (male/female) of plants prepared from seeds.

Tissue Culture (TC) Disclaimer: * TC is an experimental technology; buyers plant at their own risk.

• Guidance provided by the nursery is voluntary and carries no express or implied guarantee.

• Variations: Due to the chemical processes used in TC, variation in production, variety character, color, or seed count is possible. The company is not liable for these future variations.

• Virus-Free Certification: This confirms plants are free of known viruses at the time of production only; it does not guarantee the plants will not contract viruses once in the buyer's field.

Grafted Plants: If the mother shoot (scion) is damaged or detached from the root stock for any reason, the remaining plant will revert to the wild root stock. The company is not responsible for such damage or reversion.

Visual Representation: Actual fruit color and size may differ from brochure images due to atmospheric parameters and cultivation factors.

Payment Security: The company is not liable for cash payments made to staff or dealers. All checks must be marked "Account Payee" with the company name and amount filled in prior to delivery.
